Level2Realty, Inc., doing business as Krunching ("Krunching," "we," "us" or "our"), understands the importance of maintaining your privacy, and we therefore strive to provide our services with your protection in mind. This Privacy Policy applies to your use of Krunching’s web application located at www.krunching.com (including any successor website and all pages within such website, the "Krunching Website") that provides real estate market data, analysis tools, and community features to real estate investors to help them evaluate potential real estate transactions (collectively, the "Service"). This Privacy Policy describes our practices regarding the collection, maintenance, use and sharing of information from the Service. This Privacy Policy is maintained in conformity with any and all applicable privacy-related laws and regulations.
Our Privacy Policy may change from time to time, and those changes will be available for your review on most pages of the Krunching Website that you view and on our web page located at http://www.krunching.com/info/privacy.php. Your continued use of our Service after any such changes have been made will signify your assent to the changed Privacy Policy. Accordingly, we ask that you bookmark and periodically review this Privacy Policy to ensure continuing familiarity with the most current version.
1. Information We Collect
We do not collect any personally identifiable information about you when you use our "Basic Service". However, if you elect to register for our "Professional Investor Service", you will be asked to provide certain personally identifiable information, which may include your name, physical address, telephone number, and e-mail address. Users of the Professional Investor Service must pay a monthly subscription fee so they are also required to provide their credit card information, including credit card type, credit card number, security code, billing address, and expiration date. We may also request other information such as your age range, gender, and whether you want to receive promotional information from Krunching. You have the ability to review and update your personal and financial information and your account preferences online by clicking on a "My Account" link (or similar link) on the Service and logging into your account or by contacting us directly.
The Krunching Website will receive limited non-personally identifiable information that your browser makes available whenever you visit a website. This log information includes your Internet Protocol address, browser type, browser language, operating system, the domain name of the website from which you linked to our Service, search criteria entered by you on our Service, and the date and time of your searches on the Service. In addition, if you are logged in to your account on the Service, this log information may be linked to your personally identifiable information for purposes described below.
2. Cookies and Web Beacons
When you visit the Krunching Website, a cookie that uniquely identifies your browser may be sent to your computer. A "cookie" is a small file containing your preferences that is sent to your browser and sent back by your browser each time your browser accesses our servers. Cookies that we may use may only be read by the server that placed them there. We use cookies to improve the quality of our Service (for example, by identifying your preferences, tracking trends, or storing information you may want to retrieve on a regular basis) and to better understand how people interact with our Service (for example, by tracking user trends and usage patterns). 2. Cookies and Web Beacons
We use web analytics services provided by Google, Inc. and other third-parties to help us analyze how our users interact with the Krunching Website and to measure the effectiveness of our Service, including the advertising on the Service. Our web analytics service providers use Web beacons and cookies to collect information such as search terms, search parameters, click-throughs by users, your IP address, and other similar information. This information is transmitted to and stored by our web analytics service providers on their servers and used for the purpose of evaluating your use of the Krunching Website, compiling reports on website activity and providing other services relating to website activity and internet usage. This information helps us learn things like user preferences, popular search categories, click-through rates, how to improve our Service, and what kinds of offers our users like to see. Our web analytics service providers may also transfer this information to third parties when required to do so by law, or when such third parties process the information on their behalf. Our web analytics service providers will not associate your IP address with any other data held by them. Most, if not all, of the advertisements appearing on the Service are delivered to you by one of our Web advertising partners ("Ad Serving Partners"). To improve the relevancy and help measure the effectiveness of any advertisements on the Service, our Ad Serving Partners may use cookies, Web beacons, clear .gifs or similar technologies to record users' online activity, such as the pages visited, your search terms or phrases, or the number of times you have viewed an advertisement, and to learn what types of information are of most interest to our users. The information collected by our Ad Serving Partners through these technologies is anonymous, and our Ad Serving Partners are not authorized to collect your name, address or any other personally identifiable information about you. Use of these technologies by Ad Serving Partners is subject to their own privacy policies and is not covered by our privacy policy. 3. Information Storage and Security
All information that we collect from you, except your credit card number and billing address, is stored on our servers. We take appropriate security measures to protect data stored on our servers against unauthorized access, unauthorized alteration, disclosure, and destruction. Your credit card number and billing address will be stored on the servers of Authorize.net, our credit card processing partner. While we believe Authorize.net applies state-of-the-art security measures to protect your credit card information, we are not responsible for the acts or omissions of Authorize.net.
4. How We Use the Information We Collect
Information that we collect helps us to operate and develop our Service and better understand our users' needs so that we can continually improve the Service. For example, Krunching may use your IP address to advise you how far a particular vendor is from your location. E-mail addresses and other personal information may be used to communicate with users about new features on the Service, tips on how to use the Service, updates and other administrative items regarding the Service, customer service issues, research being conducted, promotions from Krunching or our Partners (as defined below), and other reasons. You may opt-out of receiving certain types of communications, including promotional communications, by clicking on a "My Account" link (or similar link) on the Service and logging into your account or by contacting us directly. In such case, Krunching will use best efforts to honor customers request to opt-out of promotional communications, but under no circumstances will Krunching have any liability for sending any communications, including e-mail communications, to its registered users. Users may not opt-out of receiving service announcements, which contain important information about the Service. User search criteria and activity may be utilized by Krunching in the aggregate or individually for a variety of business purposes. Any search criteria entered by you on the Service are stored and identified with your personal information so that we can provide you with information relating to your search query in the future as such information becomes available. Financial information is used to bill users for products and services purchased. Within Krunching, only accounting managers have access to credit card information. This information is not shared with anyone outside of Krunching.
Information collected from end-users may be used in aggregate form to, among other things, determine the total number of end-users who are using our Service and the demographics, interests, preferences, and behavior of those end-users, prepare utilization reports for our partners or affiliates (collectively, "Partners"), diagnose and fix compatibility problems or other problems with our Service, and perform statistical analyses to enable us to build higher quality, more useful online services. In addition, if you came to the Krunching Website through a link on another website, Krunching may be required, as part of our agreement with that website, to provide that website with aggregated data. Some of the information we collect is associated with your personal information so that we can deliver data and search results that are as responsive as possible to your individual needs and preferences (for example, alerting you when similar real estate properties to the ones you are searching for become available).
5. When We Disclose the Information We Gather
As a general rule, we do not share the information we collect from end-users with third-parties. However, when users submit a search query on our Service, search terms or phrases are transmitted to certain Partners with whom Krunching has subcontracted so that those Partners can deliver responsive Internet search results, advertising, or other services and, in some cases, for the internal data reporting purposes of those Partners. We may also disclose your information to third-parties when you consent to such disclosure. For example, if you are searching for a real estate broker, you may permit us to disclose your name and e-mail address to prospective brokers. In addition, if you have not opted out of receiving promotional communications from our Partners when registering for our Service, we may provide your information to those Partners so that they can send you promotional materials that may interest you. However, you may always opt-out of receiving these promotional communications after you have registered on the Service by clicking on a “My Account” link (or similar link) on the Service and logging into your account or by contacting us directly.
In addition, some of the information we collect is provided, in aggregate form only, to our Partners solely for purposes of calculating amounts owed to such Partners or helping such Partners improve their services, not for the purposes of marketing to our end-users. Our Partners are obligated by applicable law to protect the privacy of certain types of data; however, we are not responsible for their actions or omissions, including the manner in which they use information that they receive from us. Nevertheless, if you feel that any of our Partners, or any third party who claims association with Krunching, is improperly collecting or using information about you, we urge you to contact them directly and also to inform us by e-mailing us at privacy@krunching.com.
If in the future we sell or transfer assets or portions of our business, or if we experience a change in control, reorganization or liquidation, we may transfer any information we have collected from our end-users to our successor or buyer, subject to this Privacy Policy. We also reserve the right to share aggregated information with third-parties and to disclose any information about you if it is required by law, necessary to defend our legal rights or protect the rights, property, or safety of our users or the public against harm, or if we in good faith believe it is appropriate to cooperate in investigations of fraud or other illegal activity in which you may be involved (or are reasonably suspected to be involved), even without a subpoena, warrant or court order.
6. Advertising
We strive to make advertisements on the Service relevant and useful to you. Therefore, we may serve advertisements to you based on the information we collect from you or in relation to your interaction on the Krunching Website. However, we do not reveal your identity to any of our advertisers. Of course, if you choose to respond to an advertised offer with your name and contact information, you will no longer be anonymous to that advertiser.
7. No Responsibility for Third-Party Practices
Certain of our Partners who provide data or enable functionality on our Service may also collect information from you. We are not responsible for the privacy practices of our Partners. In addition, any websites that you click to from the Krunching Website may have been developed by third-parties over which we exercise no control. Such websites may send their own cookies to end-users, collect data, or solicit personally identifiable information from you. We are not responsible for the privacy practices or the content of such websites, including such websites' use of any information collected when our end-users click through to such websites. Even though such information might not identify you personally, we strongly encourage you to become familiar with the privacy practices of those websites.
8. Phishing
Krunching will not, at any time, request your credit card information, user ID, login password, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. Identity theft and the practice currently known as "phishing" are of great concern to Krunching. Safeguarding information to help protect you from identity theft is our priority.
